Please read these Terms of Service and End-User License Agreement ("Terms", "Agreement") carefully before using the Kip mobile application ("the Application" or "Service"). By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not download or access the Application.
1. The Service: Local Photo Management and Usage Limits
Kip is a utility tool designed to help you sort and manage the photos and media stored locally on your electronic device (the "Device").
- Local Processing: The application operates entirely on your device. We do not upload, store, or have access to your photos.
- Usage Limits, Ads, and Subscriptions:
- Free Users: You can use the application for free with a daily limit of up to 150 swipes. To support the free version, an advertisement is displayed every 40 swipes.
- Premium Subscribers: Users who purchase a subscription enjoy unlimited swipes and a completely ad-free experience.
- Age Requirement: You must be at least 13 years old to use the service. If you are considered a minor in your country of residence, you represent that you have your parent or legal guardian's permission to use the service and to make any in-app purchases.
- Acceptable Use: You may not use the application for any illegal or unauthorized purpose.
2. User Responsibility and Photo Deletion (IMPORTANT)
Please read this section carefully, as it limits Our liability regarding your data.
The core functionality of Kip relies on your manual inputs (e.g., swiping left or right) to keep or delete media from your device's photo library.
- Sole Responsibility: You acknowledge and agree that you are solely responsible for every action taken within the application. You are entirely responsible for verifying which photos you choose to delete.
- Permanent Actions: Depending on your device's operating system, deleting a photo via Kip may permanently erase it or move it to a temporary "Recently Deleted" folder managed by your OS. Kip cannot restore or recover deleted photos.
- No Liability for Data Loss: Under no circumstances shall the Company, its creators, or affiliates be held liable for the accidental, unintended, or intentional deletion of any photos, videos, or other data resulting from your use of the application. You assume all risk associated with the use of the Application.
3. Subscriptions and In-App Purchases
The application offers premium features accessible via auto-renewing subscriptions and/or in-app purchases ("Purchases").
- Billing and Payments: All Purchases are processed entirely by the applicable app store (Apple App Store or Google Play Store) linked to your device. We do not process or store your payment information.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Cancellations and Refunds: You can manage your subscriptions and turn off auto-renewal by going to your Apple ID or Google Play Account Settings after purchase. Because all transactions are handled by Apple or Google, the Company cannot directly cancel your subscription or issue refunds. All refund requests must be directed to the respective app store in accordance with their terms of service.
4. License Grant and Intellectual Property
